What is the difference between an admitted and non-admitted insurance company?

The main difference is state regulation and financial oversight.

Admitted Insurance Company

An admitted carrier is licensed by the state insurance department to do business in that state.

Advantages:

  • Subject to state regulation, rate approval, and policy form review.
  • Financial solvency is monitored by the state.
  • Policyholders are generally protected by the state’s guaranty fund if the insurer becomes insolvent.
  • More standardized policy forms and consumer protections.

Disadvantages:

  • Less flexibility in underwriting unusual or high-risk exposures.
  • Rates and coverage forms may be less customizable.

Non-Admitted Insurance Company

A non-admitted carrier (also called a surplus lines carrier) is not licensed in the state but is legally allowed to insure risks through specially licensed surplus lines brokers.

Advantages:

  • Can insure unusual, hard-to-place, or high-risk exposures that admitted carriers won’t cover.
  • Greater flexibility in policy language, underwriting, and pricing.

Disadvantages:

  • Not backed by the state’s guaranty fund in most cases.
  • Less regulatory oversight of rates and forms.
  • Coverage terms can vary significantly and require careful review.

Simple Example

  • A standard homeowners policy for a typical house is often written by an admitted carrier.
  • A home in a high wildfire area, a vacant commercial building, or a unique liability exposure may require a non-admitted (surplus lines) carrier because admitted insurers may decline the risk.

Why It Matters

If you’re evaluating a policy, especially for a business, it’s important to know:

  1. Whether the carrier is admitted or non-admitted.
  2. Whether guaranty fund protection applies.
  3. Why the coverage was placed in the surplus lines market.
  4. Whether the coverage differences justify the cost and risk.
